1        GENERAL TERMS

1.1      General Terms       

These Terms and Conditions shall be valid for the operations and all services rendered by the operator- Platinum Plus Television Ltd (hereafter referred to as PPTV) (a company duly organized under the Laws of Nigeria).

By using this service (including but not limited to the 100NS website and mobile application) the user confirms that he/she has reached the legal participation age of 18, as prescribed the National Lottery Act 2005. The operator reserves the right to verify any customer’s statement of age, at any stage, and exclude customers from its services if there are any doubts regarding the attainment of the minimum age required. Any customer using our services, who is identified as underage, shall have all his winnings forfeited and his/her account shall be blocked immediately.

Your use of the 100NairaShop website (hereinafter referred to as 100NS), a service operated by PPTV, its services and tools, are governed by the following terms and conditions. By mere use of this website, you shall be contracting with Platinum Plus TV and these terms and conditions constitute your binding obligations.

These conditions are commensurate with the agreements for rights purchase and sale within the services offered by the operator.

By using this website therefore and subscribing to our services, you accept that you shall fully comply with the rules of participation and all the terms and conditions thereto.

By using this service, you agree that participation in the 100 Naira Shop game is not commensurate to purchasing a prize, but rather exists as the creation of a chance to win said prize. Therefore, purchasing a stake and entering into a prize draw, does not in any way, directly or indirectly represent a guarantee of purchasing or winning the prize

2        DEFINITION OF TERMS       

 For these terms and conditions, the following terms are to have these meanings:

Confirmation – this is a request for authorization sent via the internal messaging system, confirming a user upon registration or at the end of a prize draw. The operator according to the guidelines of the terms and conditions sends it to the prize winner.

Cookies – these are unique identifiers that the operator transfers to your device to enable its systems recognise your device and to provide features to make your navigation and customer experience unique and targeted. Some of the stored information could be preferred language, location, cost elements or other important options. Kindly note that we only use cookies to ensure your convenience in visiting our site and not for obtaining or using any information about you.

Devices – this describes the hardware being used to access the service, including but not limited to desktops, laptops or mobile devices utilised by vendors and users to access the service.

Number of Stakes Left - the remaining number of stakes to be purchased by users for an item, before a winner can emerge from a prize draw.

Operator - Platinum Plus Television Ltd (PPTV), a company duly registered with the Corporate Affairs Commission of Nigeria under Nigerian laws (RC 601460). The operator undertakes all its activities in full compliance with The National Lottery Act (2005) and The National Lottery Regulation (2007), regulated by the Nigerian Lottery Regulatory Commission (NLRC).

Play or Purchase Stakes – the process of purchasing stakes to win desired items after a prize draw, conducted under these Terms and Conditions.

Prize – This could be a product or service (tangible or intangible) given to the winner at the end of the prize draw process.

Prize Draw – This entails activities including prize creation, prize stake sales and winner selection, for a specific prize. Each prize created make up an independent prize draw.

Prize Winner – the user who will emerge as winner from the prize draw.

Random Number Generator – This is a safe and secure system, in-built in the 100 Naira Shop platforms, that selects a stake number randomly for a prize, and the user holding that stake becomes the prize winner

Results – This represents the outcome of the prize draw process, usually consisting of the name(s) of the winner of the prize draw

Service – herein refers to the online transactions rendered or facilitated by PPTV on the 100 Naira Shop, through its website or mobile app, where stakes are purchased, prize draws are organised and winners are randomly selected for each item played for.

Stake – A stake represents a chance to potentially emerge the winner of the prize. Purchasing a stake and entering a prize draw, automatically gives the user a stake in that prize draw

Stake Price – the money equivalent in Naira per stake that a user must purchase to enter a prize draw. The operator will publish the relevant Stake Price.

User – an individual with full legal capacity to participate in a lottery, possessing verifiable means of identification, is registered with the operator, and has been granted approval to possess an account on the 100NS. The user is identified by the first name, surname, and/or email, and a password for data protection.

User Account – comprising of recorded data constituting a unique profile name (Username) and his/her account history within the service. The operator on behalf of the user or vendor manages the user account. The data is displayed under "Dashboard". Users are entitled to one account only.

Wallet – an electronic store for funds used in converting currency into credits that can be used for purchases on the platform.

Winner Selection – The process of selecting a winner using an electronic random number generator

3        TERMS OF USE     

The terms and conditions forbid actions such as: accessing our servers or data systems, impeding in any way the functionality of the site, mobile app or any other platform that has access to the service. It also forbids collecting or manipulating any underlying software code, violating any intellectual property rights.  This list is not comprehensive and as such actions similar to those previously stated, are also strictly forbidden.

The operator possesses the rights to terminate any granted access a user has to the service, after determining at their sole discretion that the user breached any of the terms and conditions. This shall be done without preconception to any available means of reparation at law or otherwise.

The owner of an account shall be held responsible for any activity done using that account and password. As a result, a user must inform the operator of any irregularities or unpermitted use of his/her account or password.

The service shall not be directly or indirectly responsible for any loss or damage of any kind sustained in connection with, or as a result the inability of a user to comply with the stated terms and conditions.

Users agree to receive promotional SMS and emails from the service during and after the period of registration. Users can subsequently opt out of the receiving adverts and email promotions from the service by clicking “unsubscribe” at the bottom of any of the promotional emails.

If you do not agree with the terms and conditions, or wish not to be bound by them, you completely agree to refrain from using the site, mobile app or any other platform that has access to the service.

3.1      Information Provided by the Operator

Although the operator takes reasonable steps to ensure the accuracy and reliability of the information provided on the website and mobile application, such information shall not represent a guarantee or a      warranty and is subject to change without notice.

3.2      Intellectual Property

Both parties agree that all intellectual property rights and database rights, whether registered or unregistered, in the Site, information content on the Site and all the website design, including, but not limited to, text, graphics, software, photos, video, music, sound, and their selection and arrangement, and all software compilations, underlying source code and software shall remain at all times vested in us or our licensors. Use of such material will only be permitted as expressly authorized by our licensors or us.

Any unauthorised use of the material and content of this website is strictly prohibited and you agree not to, or facilitate any third party to, copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

3.3      Links, Advertisements and Third-Party Websites

In the event that a user follows an external link or advertisement to a third-party website, he or she does so at his or her own risk. We accept no responsibility for any content, including, but not limited to, information, advertisements, products and services, available on third party websites.

3.4      Registration

To access the 100 Naira Shop, you will need to register with your name, address, date of birth, email and any other information requested. It is required that all information requested be correct, up-to-date and complete. The provision of this information helps the operator establish whether you meet the criteria for participation.

In the event of violation of any of the sections in this term of use, the operator reserves the right to suspend or refuse the user access to the website, mobile apps or any of our resources, or permanently shut down your user account.

All information provided during registration, including but not limited to any document generator or interactive feature, is governed by our privacy policy that applies to all site and mobile visitors. And as such, you must treat all information you are provided with during registration as confidential. Hence, you should not disclose this to anyone or entity.

The user is only allowed to modify the registered username or phone number, upon request and approval by the operator.

All created usernames must be unique to one (1) account only, which is the maximum number of accounts a user can have.

  1. A user is not permitted to use another user's account or let others use his/her account.
  2. All accounts are non-transferable, and the operator reserves the right to vet and confirm a user's information and identity.

An agreement is deemed to have been reached between the operator and the registered entity upon registration of a user account. And the service being provided according to the guidelines in the terms and conditions is herein referred to as the ‘subject matter’.

The operator reserves the right to conduct frequent checks on user accounts, even after user account creation. If any discrepancies are found, the operator reserves the right to deny the user, access to his/her accounts.

Where a change in user information is inevitable, the user is required to send an email to the operator via the email address provided for enquiries, with details of the change in information desired.

These terms and conditions comprise of all the actions and expectations that every user must comply to.

No user can upload or publish content that breaches the law or recognized moral standards in any way. Users shall be notified in the event where non-tolerated actions or behaviors are observed. Such actions or behaviors shall warrant penalties being imposed on the user.

The registered user possesses the rights to engage in events and contests that the operator organizes with rules defined according to the Lottery Regulations.

3.5      User's Proof of Identity

By law, the operator reserves the right to request a user's proof of identity and/or eligibility to participate on the service. Hence, all information requested by and supplied to the operator must be accurate, complete and not misleading in any way.

Refusal to provide such proof may result in termination of the terms and conditions, and subsequently lead to suspension of such user accounts.

3.6      Electronic Wallet and Funds Transfer

An electronic wallet (e-wallet) is created along with a user account on the service. The user can view his/her account balance on the wallet, transfer funds to another user and convert loyalty points to funds on the wallet. The operator refers to funds on the wallet as units.

The operator shall not be held liable or responsible for the payments made by a user, into or out of the wallet.

Once a user funds the wallet, the units are not refundable unless otherwise used by the user to perform a transfer to another user on the service, or the user uses the remaining balance to buy more stakes.

The user shall not be able to cancel a request to transfer units to another user on the wallet after the request is made.

The user shall not be able to link the wallet to a third party to pay for goods and services, neither are units on the wallet able to be withdrawn from ATMs or using any other payment portal.

The service may impose limits on the amount of money a user can transfer, or the number of stakes a user can purchase in a period. Such conditions are subject to the activities of the user.

3.7      User Submissions

User submissions including but not limited to comments, questions, suggestions and reviews, collectively called submissions provided by a user and collected by the service on behalf of the operator, shall not be returned to the user. Such submissions become exclusive properties of the operator to be used according to the agreements in this terms and conditions.  

3.8      Uncontrollable Events (Force Majeure)

The operator will not be liable for delay or failure to perform its obligations under this agreement, if this delay or failure is caused by circumstances beyond reasonable control. Such circumstances include but are not limited to total internet shutdown, an Act of God, war and conflict, social civil disruptions or industrial dispute resulting in delays or failure that could not have been prevented or overcome by the operator.

3.9      Termination of Agreement

The operator reserves the right to terminate the terms and conditions or revoke all access granted to a user under the terms and conditions without prior notice to the user. If the user is dissatisfied with the service, or with any terms, conditions, rules, policies, guidelines, or practices of the operator in operating the service, the user should immediately discontinue using the service.

4        TERMS OF SALE 

4.1      Purchasing Stakes

Each item is displayed for a specific period, to be determined by the operator. Registered users who purchase stakes and automatically partake in the prize draw, where a winner emerges, can win the displayed items.

Purchasing of stakes begin as soon as the operator publishes a product/item to be won on the 100NS website or mobile app. The number of stakes to be purchased for each item is dependent on the price of the item along with shipping costs. The number of stakes available for sale on a particular item is to be decided by the operator.

Only registered and logged in users can purchase stakes and win on the service

Users purchase stakes on the service by selecting the desired number of stakes to be purchased, and clicking on the "purchase" button on the ‘item’ page.

As users purchase stakes, the number of available stakes for the purchase of the items to be won decreases accordingly.

Purchasing stakes increases the user’s chance of being randomly selected from the prize draw. The greater the number of stakes purchased by the user, the greater the probability of being selected as the winner.

It should be emphasised that the purchase of single or multiple stakes by a user, does not in any way guarantee the user, winning the products/items played for. The operator posits that the central themes on which a lottery business operates on, are ‘chance’ and ‘probability’, and thus there can only be one winner per prize draw.

4.2      Draw Cancellation

In the event of suspicions of result tampering, bugs, computer hack, virus, security breach or other reasons beyond the reasonable control of the operator, the operator reserves the right to suspend or cancel a draw, at any stage, without prior notice.

In the event of cancellation of a draw, all stakes purchased in respect of the relevant product, will be returned to the electronic wallets of the respective users, within 24 hours.

In the event of cancellation of a draw, the operator reserves the right to investigate the cause of such a breach and take appropriate sanctions on responsible parties.

4.3      Winning and Prize Redemption

Following the purchase of all the available stakes for an item by participating users, the draw will be closed, and a winner randomly selected.

  1. The operator will exercise no control or influence over the process and outcome of the winner selection process.
  2. Every purchased stake number will stand a fair chance of winning the prize.

The operator undertakes no liability for loss, damage or loss of profits from reliance on potential winnings.

The winner will be notified via email and/or SMS, depending on the information provided by the user during registration.

The winner will be required to go through the prize claims process to redeem prize(s) won.

Kindly note that every user will be required to undertake an age verification procedure, prior to prize redemption. Customers will be required to provide proof of age, by providing a valid, verifiable means of identification, including but not limited to a drivers licence, birth certificate, international passport and voters card.

The operator undertakes to use all reasonably practicable measures to contact and deliver prizes to all winners.

  1. However, following the expiration of 180 days from the end of any prize draw, all unclaimed prizes shall be retained or disbursed subject to the discretion of the operator.
  2. All legitimate claims of winners in respect of prizes unclaimed after 180 days can be approved or refused subject to the operator’s discretion.

The winner will be required to provide a correct address for the delivery of prizes if the delivery option is chosen by the winner during the prize claim process.

Following the completion and approval of the prize claims process, the operator will make effort to deliver goods within estimated time scale for delivery defined for that prize draw.

The user agrees not to hold the operator liable for any delay or failure to deliver products or otherwise perform any obligation as specified in these Terms and Conditions, if the same is wholly or partly caused whether directly or indirectly by circumstances beyond our reasonable control.

The operator reserves the right to take personal information, photographs or videos of prize winners to be used in online or offline promotion activities for the sole purpose of marketing alone. The user will be notified before such promotion activities are undertaken

4.4      Complaints and No-Return Policy

The operator is dedicated to strict standards of customer service and ensuring customer satisfaction.

The operator operates a strict no-return policy. However, in the rare event that you recieve defective goods/prizes, damaged good/prizes, goods which are unfit for purpose, substantially differ from their description or are counterfeit, the complaints policy should be adhered to.

Thus, the operator posits that users are obliged to make a complaint where they are not satisfied with the service according to, but not out of the scope of the terms and conditions.

All complaints and requests for additional information are to be directed towards customer service, through an email address or telephone number provided by the operator on the website.

The operator operates a thorough 3-step internal complaint procedure.

The first step of the complaint procedure is the responsibility of customer service. Our top-notch customer service operatives will attempt to resolve the complaint.

In the unlikely event that a resolution is not reached by customer service in the first step, a manager will then be asked to review the complaint and provide a response within 10 working days

If the user is still not 100% satisfied by the decision of the manager, the complaint is then taken higher, to a director, who will further investigate the complaint and provide a response within 10 working days

Any further dispute or claim arising out of the operator’s services or relating to these Terms and Conditions will be referred to and settled by Alternative Dispute Resolution (ADR).

The operator’s preferred medium of Alternative Dispute Resolution is Arbitration. Thus, complaining users agree to be referred to private and confidential binding arbitration, to be held in Nigeria, governed by Nigerian law and in pursuance to the Arbitration and Conciliation Act Cap A18 Laws of the Federation of Nigeria 2004.

4.5      Responsible Gaming

Platinum Plus TV-100 Naira Shop is dedicated to the ensuring the highest levels of customer service and consumer protection. The operator recognises the fact that while gambling can have a wide range of benefits, it also has negative consequences.

Therefore, the operator encourages responsible and ethical gaming.

4.6      Applicable Law & Jurisdiction   

These Terms and Conditions shall be interpreted and governed by the laws in force in the Federal Republic of Nigeria. Each party hereby agrees to submit to the jurisdiction of the courts of Nigeria and to waive any objections based upon venue.
